Terms & Conditions

Welcome to the Homeowners Equity & Liquidity Plan (HELP) administrative gateway. These Terms & Conditions govern your access to and use of our platform. By accessing or using the gateway, you agree to be bound by these terms. If you do not agree, please do not use our services.

⚠️ Important notice: HELP operates solely as a private administrative gateway for structured property participation research. We do not provide financial advice, investment recommendations, or lending services. Independent professional advice is mandatory before any decision.

1. Platform Purpose & Role

The HELP platform is designed to facilitate administrative intake, portfolio assessment, and eligibility screening for individuals interested in exploring potential property participation structures. We act as an intermediary gateway, not as a financial institution, investment adviser, or credit provider.

2. Membership & Fees

2.1 Annual administrative membership

Access to certain platform features, including eligibility screening and gateway communications, requires an annual membership fee of $299 AUD. This fee is administrative in nature and is not an investment, deposit, or prepayment for any future allocation. Membership renews automatically each year unless cancelled prior to the renewal date. You will receive a 14‑day advance renewal notification email.

2.2 No guarantee of participation

Membership does not guarantee that you will be matched with any project, receive any allocation, or obtain any form of property participation. All opportunities are subject to third‑party structuring, eligibility criteria, and independent professional assessment.

2.3 Cancellation & refunds

You may cancel your membership at any time through your dashboard or by contacting us. Fees are non‑refundable except where required by law. If you cancel, access to member‑only areas will cease at the end of the current billing period.

All content on the platform – including text, graphics, logos, calculators, and software – is the property of HELP or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.

5. Third‑Party Links & Independent Advice

The platform may contain links to third‑party websites or refer you to independent professionals. These are provided for convenience only; we do not endorse or control those third parties. Any engagement with a third party (including licensed advisers) is solely between you and that party. HELP accepts no liability for their advice or services.

6. Limitation of Liability

To the maximum extent permitted by law, HELP and its affiliates, directors, and employees shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the platform. This includes any loss of equity, investment loss, or failure to achieve anticipated liquidity.

Our total liability to you for any claim arising from these terms or your use of the platform is limited to the amount you have paid us (if any) in the preceding 12 months.

7. Indemnification

You agree to indemnify and hold harmless HELP from any claims, losses, liabilities, or expenses (including reasonable legal fees) arising out of your breach of these terms, your misuse of the platform, or any information you provide that is inaccurate or unlawful.

8. Termination

We reserve the right to suspend or terminate your access to the platform at our sole discretion, without notice, if we believe you have violated these terms or engaged in conduct that may harm the platform or its users. Upon termination, your right to access member areas will immediately cease.

9. Privacy & Data

Your use of the platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the platform, you consent to such collection and use.

10. Changes to Terms

We may update these Terms & Conditions from time to time. When we do, we will revise the “Last updated” date at the top. Your continued use of the platform after changes constitutes your acceptance of the revised terms. We encourage you to review this page periodically.

11. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any dispute arising out of or relating to these terms or the platform shall be resolved exclusively in the courts of New South Wales.
